The
program has responsibility for compensation and for administration of
federal and state victim services grants. The program was created in 1978.
FUNDING
The program receives an annual appropriation, as well as a VOCA grant.
ELIGIBILITY
REQUIREMENTS
Law enforcement reporting period: 5 days
Filing period: 1 year
Exceptions: For child victims, reporting deadline is 5 days from disclosure,
or 18th birthday if adult fails to report on victim's behalf within
5 days of disclosure; filing deadline is 1 year from 18th birthday.
Report deadline may be extended.
PROCEDURES
After initial document gathering, a claims specialist reviews application
and makes a recommendation to award or deny. If the claims specialist
recommends denial, the program director is given the file for final
decision making.
Appeals: Applicant
has 30 days to request in writing a reconsideration by the program.
If the program director does not change the decision, the applicant
may seek a hearing before an administrative hearings examiner. A final
appeal may be taken in circuit court.
BENEFITS
Maximum award: $40,000; plus additional $2,000 for funeral expenses

includes lost wages for household/family members to attend funeral
- Funerals: $2,000
- Replacement services:
homemaker and childcare services
- Crime-scene cleanup/evidence:
$1,000 to secure and clean crime scene; $300 to replace clothing or
bedding held as evidence; $200 to replace property made unusable by
crime-laboratory testing
- Attorney fees:
up to 10% of award or $100, whichever is less
- Emergency: $500
