Created
in 1978, the program operates as a part of the Criminal Justice Institute.
In addition to victim compensation, the program operates a special procedure
to pay for forensic examinations and counseling for eligible sexual-assault
victims.
FUNDING
Court costs assessed against offenders are paid to the state, and the
compensation program receives a portion thereof. The assessment is automatic.
The program also receives 10% of wages earned on work release. The program
is eligible for a VOCA grant.
ELIGIBILITY
REQUIREMENTS
Law enforcement reporting period: 48 hours
Filing period: 180 days; may be extended to two years
Exceptions: For sex crimes, time periods are extended to 2 years
Minimum loss: $100
PROCEDURES
The program director makes decisions on applications.
Appeals: Applicant
has 30 days to file an appeal. A hearing officer handles the hearing
and makes a determination. The applicant may take a further appeal to
the Criminal Justice Institute Board of Trustees.

Maximum award: $15,000

counseling: limit of $1,500 if therapist charges sliding-scale fees
based on victim's income; limit of $1,000 if no sliding scale is used;
limit of $1,000 for family of victims of homicide, sex assault, and
domestic violence
- Lost wages/support
- Funerals: $3,000
- Attorney fees:
commensurate with services rendered; limit of 15% of first $5,000
of award and 10% if award exceeds $5,000
