The commission is the administrative agency for the Arizona Crime Victim Compensation Fund. The commission designates one operational unit in each of 15 counties (currently the county attorney's office) to administer the fund subject to state statute and rules. The program began operating in 1988.
FUNDING
The Victim Compensation Fund receives 4.6% of monies paid into the Criminal Justice Enhancement Fund, which is financed by penalty assessments on fines. The program receives an annual VOCA grant.

ELIGIBILITY REQUIREMENTS
Law enforcement reporting period: 72 hours
Filing Period: 2 years
Exceptions: Exceptional circumstances

PROCEDURES
Victims apply to the board in the county where the crime took place. The coordinator in each county develops the case file, and each county's board meets regularly to determine all claims.

Appeals: The victim may appeal a decision of the board to the board within 30 days. Further appeal is filed with the superior court in each county under Rules of Administrative Procedure.

BENEFITS
Maximum award: $20,000

Compensable Costs (with limits)

  • Medical expenses
  • Mental health counseling: up to 36 months from date of first treatment
  • Lost wages/support: limited to 40 hours per week at current federal minimum wage law. Work loss up to 40 hours per month for parent of minor victim when accompanying victim for treatment.
  • Funerals: $5,000
  • Travel: for medical care and counseling
  • Emergency: $500
